Constitutional Court with Temporary Measure over Nationality Column

The Constitutional Court has decided to launch proceedings over parts of three articles of the Law on Registry which contain the word “nationality” in birth, death, and marriage certificates.

According to the Court, those contested provisions are not in line with Articles 8 and 18, which guarantee personal data secrecy. Starting from today and until the Court’s final decision, services are not allowed to ask for such data from citizens for inclusion of nationality in certificates, considering a so-called temporary measure has been adopted, the Court said on Wednesday.

The same day, the Justice Ministry said the Court had made “another two decisions to annul a Rulebook and a Decision for which the court assessed there was overstepping of the constitutional deadline for publication in the Official Gazette.” The two matters had been contested by Minister Krenar Lloga.
