Former Justice Minister Krenar Lloga, who’s part of the Alliance for Albanians wing headed by Ziadin Sela, has slammed the Constitutional Court’s decision to launch a procedure to assess the constitutionality of the Balancer tool, which concerns ethnic affiliation as one of the conditions for a job in the administration sector.
As he pointed out, there was an ethnic vote, that is, Wednesday’s session of the Court saw the six votes in favour come from ethnic Macedonians, whereas the three against came from the Judges from the ethnic Albanian and Turkish community.
Sela himself believes that a new law is needed for the Constitutional Court to make decisions by a Badinter majority when it comes to laws impacting ethnic communities.
The Democratic Party of Turks, too, said it was concerned by the polarisation along ethnic lines within the Court.
When it comes to the Public Administration Ministry, it will wait for the Court’s final decision before making a decision on its own on whether it will initiate a new law on equitable representation on the basis of expertise, not along party and ethnic lines.
