On an episode of Kanal 5 CEO Ivan Mircevski’s podcast, Constitutional Court President Darko Kostadinovski says his institution’s decision ordering Parliament to make changes to the 2023 Criminal Code amendments is final and executive, adding that the legislative house has to make them.
Regarding Speaker Afrim Gashi’s stand that he will not accept orders and deadlines from other institutions, that is, that he will act only in line with the Rules of Procedure, Constitution, and Law on Parliament, he points out that precisely the Constitution puts Parliament under the obligation to implement the Court’s decision and that if that doesn’t happen, the next step will be abolition or annulment.
Gashi, however, has adhered to his stand that Parliament will not act upon rulebooks and acts of other institutions.
“It’s their full right to make a decision on some law. However, until there is no decision, we cannot act. That topic is sensitive. All of us want to reach a new law that satisfies all sides”, he points out.
