No Supreme Court justice has applied in the race for a Judicial Council seat. The previous competition saw only Justice Nake Georgiev apply. Though he’d been elected as a member, he left the position in order for his son to be able to become a Criminal Court Judge.
The resignation had been filed before he was sworn in in Parliament. That had been preceded by a fierce discussion within the Council. However, the stand that it’s illegal to elect his son while he’s part of the body prevailed because according to the Law on Courts, a person who is related in vertical or horizontal line up to third degree or is a spouse of a member of the Judicial Council cannot be elected judge or lay judge.
In the period ahead, the Council will need to schedule a new competition.
