Justice Ministry Starts Procedure to Dismiss Kocevski as Chief Prosecutor

The Justice Ministry has started the procedure to dismiss Ljupco Kocevski as Chief Prosecutor. On Friday, it submitted the opinion to the Government.

As the Ministry said, the past period has seen a series of problems, including a violated functionality of the Chief Office, illegal action, corruption, inefficiency in criminal and prosecution.

“Kocevski acted in cases in which, according to legal provisions, circumstances existed causing suspicions over his impartiality, as well as conflict of interest”, the institution also said, adding that Kocevski should have been aware of those circumstances and recused himself.

Now, the process to dismiss Kocevski will be transferred to the Council of Public Prosecutors, which has a 30-day deadline to present an opinion. Once the Government gets it, it will submit it alongside the dismissal proposal to Parliament.

An absolute majority of 61 MPs is required for dismissal. According to Justice Minister Igor Filkov, even if the Council presents a negative opinion, that will not mean the procedure to dismiss Kocevski will finish.

“The Ministry and Government have an obligation to take all legal measures and respect the process provided for in the Public Prosecutor’s Office Law, including the possibility to launch a procedure before Parliament”, he noted in an interview with the MKD portal.
