Race for ECHR Judge: Kadriu Says Commission Perhaps Made Procedural Mistake

Constitutional Court Judge Osman Kadriu, member of the commission whose list of candidates for European Court of Human Rights judge was abolished by the Government, says the body perhaps made a procedural mistake.

He explains for Kanal 5 that instead of the list first being submitted to the international Advisory Panel of Experts of the Council of Europe (CoE), the commission decided to preliminary send it to the Government for legal and political reasons.

Kadriu points out that he was advocating for the Government to be preliminary notified, considering, as he stresses, that it will have a chance in the second round of the procedure, too, when the list will be returned from the international body of experts, to voice a stand.

“We had discussions, dilemmas as to whether the proposal should be truly submitted to the Council directly, as recommendations require. Perhaps it’s a procedural mistake on our part why we didn’t submit them directly”, the Judge stresses.

In his view, the Government’s decision to abolish the entire list, change the previous commission, and reduce it to a five-member body, instead of it having nine, is questionable. The previous body, he notes, had two key criteria: expertness and morality.
