Constitutional Court Annuls Parts of 2021 Census Methodology

The Constitutional Court has annulled parts of the methodology on the 2021 census that concern “resident” and “non-resident” population it believes are not in line with the rule of law.

According to the institution, then-State Statistics Office Director Apostol Simovski overstepped his authorizations and, through a by-law, carried out the categorization process.

As the Court explained on Thursday, the Law on Census of the Population doesn’t provide for the categorization of the population to be considered through a by-law. The decision will not impact the 2021 census.

Considering it’s about a decision to annul, not abolish, the parts, the Court explained, it will enter into force once it is published in the Official, but will not apply retroactively.
