The Constitutional Court has initiated proceedings to assess the constitutionality of the 2023 Criminal Code changes, that is, amendments to Article 353, which resulted in the expiration of the statute of limitations in a big number of cases against former and current officials.
Now, according to the procedure, the Court will draw up a report that will be sent to Parliament, which will be notified that the judicial instanton has suspicions when it comes to the Code’s constitutionality.
After that, Parliament will have a six-month deadline to intervene and change the contested provisions. In the event of that not being done, a judge-rapporteur will draw up a paper on repealing or annulment.
