The Skopje Basic Civil Court has again banned the strike announced by the Trade Union of Flight Controllers. M-NAV’s lawyer has said the decision confirms again that the Union cannot act independently as an affiliate.
The decision banning the strike is founded on three grounds: the strike request contains no request for protection of a labor right; the mandatory reconciliation procedure hasn’t been carried out; and the Union, as an affiliate, has no legal legitimacy to organize and stage strikes independently.
Due to the announcements that the Union will again initiate, i.e., announce strikes, M-NAV has launched a separate legal procedure seeking the Court to determine that the Union, in general, has no right to act as an affiliate independently and organize and carry out strikes.
The lawyer also says a charge has been filed against the Union’s President, Aleksandar Tasevski. As it is explained, he used five days off for Union activities, but went on private vacation instead of attending meetings. Since the days off were paid, he abused official duty, it is pointed out in the charge, and caused damage of around 1,100 euros.
However, Tasevski says none of that is true, adding that the goal is to cause discord within the Union. He also stresses he will file a defamation lawsuit.
