The Kocani Basic Court has requested that it be recused from the process to assess the bill of indictment concerning the 16 March Pulse fire as a result of legal obstacles.
Citing the Criminal Procedure Law, the Court explains that all five judges have so far acted in processes to issue measures against those charged, which is why they cannot now decide on the bill.
The Stip Court of Appeals has told Telma that it will make a decision once it observes all circumstances in terms of whether the Kocani Court is able to take action or not.
Prior to that, it will request also an opinion for transfer of competences to the Higher Prosecutor’s Office. If the second-instance institution accepts the Kocani Court’s request, the competence can be transferred to another such institution from the same Appeals area.
