Regarding the reactions to the decision closing the Modular Hospitals case, the Prosecutor’s Office for Prosecution of Organized Crime and Corruption has said it maintains its stance of not commenting on political statements.
At the August 19 press briefing, the Chief of the Office, Islam Abazi, emphasized that the resolution closing the pre-investigation was not a final decision, as well as that should new information or evidence emerge at any moment, the case could be reopened.
The question also arose as to whether an appeal could be filed with the Higher Public Prosecutor’s Office and, if so, who could do so. Several days ago, the Office explained that there was no party eligible to file an appeal because the case had been opened on the basis of rumor rather than upon a specific criminal complaint, as well as that no damages had been determined.
The absolute statute of limitations regarding abuse of official position pursuant to the 2023 Criminal Code amendments is 10 years.
