The Supreme Court has presented the rationale regarding its decision to overturn the verdict in the Laskarci case, which concerns the 2019 bus crash in which 16 people were killed and 30 were injured.
The Appellate Court, it explained, failed to conduct super-expertise processes regarding the health condition of driver Manuel Trifunovski, while it also failed to sufficiently address the causal link between the actions of the convicted persons and the traffic accident.
“Such a conclusion by this Court stems from the expert analyses and super-expert analysis conducted, which identify the lapse of convict M.T. as the cause of the traffic accident, while also noting the substandard technical condition of the bus, without specifying to what extent such malfunction contributed and how it was reflected in causing the accident in question. This is all the more significant given that the expert analyses show there were no skid marks”, the Supreme Court’s rationale reads.
