Debate on Constitutional Appeal Instrument

Air pollution, wire-tapping, violation of the right to inheritance, maternity, and ownership are among the constitutionally guaranteed rights of citizens over which they cannot start a procedure before the Constitutional Court because the instrument of constitutional appeal doesn’t exist in the country.

As the Court’s President, Dobrila Kacarska, said on Wednesday, over the past three decades, hundreds of applications by citizens have failed as a result of the problem with the non-existence of the mechanism. Support for introduction was expressed by President Stevo Pendarovski.

“Even though so far, there have been multiple initiatives to change the Constitution in this field, а whole series of parliamentary compositions hasn’t mustered strength to do that,” he noted.

Germany’s support was conveyed by Ambassador Petra Drexler. North Macedonia is the only former Yugoslav republic without the instrument.
